Resolution No. PC-89-38 <br />Page 2 <br />C. That the proposed conditional use will comply with <br />each of the applicable provisions of the Municipal <br />Code. <br />The proposed use will comply with all applicable <br />sections of the Zoning Ordinance. One intention is <br />to meet the local retail needs of neighborhood <br />areas. The proposed use also complies with other <br />sections of the ordinance, for surrounding uses <br />will not be subject to noise, odor, dust, heavy <br />truck traffic or other objectionable influences. <br />WHEREAS, projects of this nature are categorically exempt from <br />the requirements of CEQA. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br />Section 1. Approves Case UP-89-9, the application for a <br />conditional use permit to operate a video sales and <br />rental business within an existing retail commercial <br />complex located at 2889 Hopyard Road subject to the <br />following conditions: <br />1. That the proposed use shall be substantially as <br />shown on the site and floor plans, Exhibit A (dated <br />February 24, 1989) on file in the Planning <br />Department <br />2. That the operation shall be confined to the video <br />store operation.- Any changes or modifications to <br />the use shall be subject to review of the Planning <br />Director. If the change is determined to be <br />substantial, then a new application for a <br />conditional use permit shall be required. <br />3. The area set aside for adult videos will clearly <br />post an "Adults only" sign. This area will be <br />regulated by employees and will follow the <br />restrictons outlined in the Municipal Code Section <br />6.32.040. <br />4. That the applicant shall apply for and receive all <br />applicable City permits for the business prior to <br />the operation. <br />Section 2. This resolution shall become effective <br />15 days after its passage and adoption. <br />
