PLANNING COMMISSION CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION N0. PC-89-38 RESOLUTION APPROVING CASE UP-89-9, THE APPLICATION OF KYONG KIM AND HOLIDAY VIDEO WHEREAS, Kyong Kim and Holiday Video have applied for a conditional use permit to operate a video sales and rental business within an existing retail commercial complex located at 2889 Hopyard Road; and WHEREAS, zoning for the property is C-N (Neighborhood Commercial) District; and WHEREAS, at their duly noticed public hearing of March 22, 1989 , the Planning Commission considered all public testimony, relevant exhibits and recommendations of the City staff concerning this application; and WHEREAS, the Planning Commission made the following findings: A. That the proposed function of the conditional use is in accordance with the objectives of the Municipal Code and the purpose of the district in which the site is located. The purpose of the C-N District is to provide service establishments, both retail and office, that cater to the needs of the neighboring area. A video store would provide a convenient location for movie rentals and add to the overall diversity of the shopping center. B. That the proposed location of the conditional use under which it will be operated or maintained will not be detrimental to the public health, safety or welfare, or be materially injurious to the properties in the vicinity. The proposed use would not adversely impact surrounding businesses for there is ample access and parking available within the shopping center to accommodate a video store. The hours of operation are similar to those of the surrounding tenants. The adult video section will not be visible to minors and will be regulated by employees. The applicant will be required to apply for a new conditional use permit if the adult section is enlarged or changed substantially.
