PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION N0. PC-89-38 <br />RESOLUTION APPROVING CASE UP-89-9, THE APPLICATION OF <br />KYONG KIM AND HOLIDAY VIDEO <br />WHEREAS, Kyong Kim and Holiday Video have applied for a <br />conditional use permit to operate a video sales and <br />rental business within an existing retail commercial <br />complex located at 2889 Hopyard Road; and <br />WHEREAS, zoning for the property is C-N (Neighborhood Commercial) <br />District; and <br />WHEREAS, at their duly noticed public hearing of March 22, 1989 , <br />the Planning Commission considered all public testimony, <br />relevant exhibits and recommendations of the City staff <br />concerning this application; and <br />WHEREAS, the Planning Commission made the following findings: <br />A. That the proposed function of the conditional use <br />is in accordance with the objectives of the <br />Municipal Code and the purpose of the district in <br />which the site is located. <br />The purpose of the C-N District is to provide <br />service establishments, both retail and office, <br />that cater to the needs of the neighboring area. A <br />video store would provide a convenient location for <br />movie rentals and add to the overall diversity of <br />the shopping center. <br />B. That the proposed location of the conditional use <br />under which it will be operated or maintained will <br />not be detrimental to the public health, safety or <br />welfare, or be materially injurious to the <br />properties in the vicinity. <br />The proposed use would not adversely impact <br />surrounding businesses for there is ample access <br />and parking available within the shopping center to <br />accommodate a video store. The hours of operation <br />are similar to those of the surrounding tenants. <br />The adult video section will not be visible to <br />minors and will be regulated by employees. The <br />applicant will be required to apply for a new <br />conditional use permit if the adult section is <br />enlarged or changed substantially. <br />
