non-project boundary line or other property line than
will enable fire hazard management measures
satisfactory to the Fire Marshal to be implemented on
lands under the control of the owner and/or homeowners
association.
9. The applicant shall receive written permission from the
owner of the parcel immediately to the west (Montgomery
parcel) for all landslide repair and/or grading
on this parcel required by the project improvements
prior to these improvements being shown on a tentative
map. In the event this permission is not received, the
PUD development plan must be modified as necessary
before a tentative map is submitted showing revised
improvements.
10. Access to the westerly (Montgomery) parcel shall be
maintained at all times during construction. The
applicant shall submit a plan to the City showing how
access will be maintained during construction of the
main road for City review and approval prior to the
issuance of a grading permit.
11. The parcel immediately west of the development
(Montgomery parcel) shall be granted an easement over
the Equus Heights subdivision's streets as necessary to
provide access. This parcel shall be accorded access
without being a party to the project CC&R's unless the
parcel's owner wishes to join said association.
12. The applicant shall dedicate across the full project
frontage, at the time of the first final map, right-of-
way along Foothill Road sufficient to accommodate a
four-lane Foothill Road, with median, as described in
the General Plan. This right-of-way shall be based on
the 1972 Foothill Road Precise Alignment, or a more
recently adopted alignment, and should include slope
banks within the right-of-way.
13. The applicant shall construct interim street
improvements on Foothill Road to the satisfaction of
the City Engineer to effect safe ingress and egress for
the development. These improvements shall include left
turn, acceleration, and deceleration lanes as generally
shown in the development plan but with shoulders added
to Foothill Road south of Muirwood Drive. Project
streets should be designed to meet Foothill Road at the
ultimate right-of-way width, with interim improvements
to connect to the existing Foothill Road.
14. The applicant shall enter into a deferred improvement
agreement with the City for the construction of
frontage improvements from right-of-way to and
(as revised at the 2/8/89 Planning Commission Meeting)
-2-
