9. That the area of the private street (from edge of <br />curb/sidewalk to edge of curb/sidewalk) and the common open <br />space area shall be clearly shown on the final map as a <br />separate parcel or as two separate parcels. <br />10. That the applicant shall modify the site development standards <br />for accessory structures to conform with the recent Municipal <br />Code amendment pertaining to portable spas. <br />il. That the applicant shall comply with all recommendations of <br />the updated tree report dated "Received November 19, 1990." <br />12. That the applicant show on the improvement plan any retaining <br />walls that will be necessary to protect trees numbered 47 and <br />48. <br />13. That the drainage of the lots shall be subject to final review <br />and approval by the Building Department. <br />14. This tract map is subject to all conditions of approval of <br />PUD-90-8. <br />15. This tract map shall be subject to the conditions contained in <br />the Memorandum from the Engineering Division, dated November <br />21, 1990. <br />16. That the applicant and the applicant of Tract 6383 shall pay <br />the required fee for undergrounding of utilities along Stanley <br />Boulevard. This fee shall be based on 170 feet of lot width. <br />In the event that this project is developed at approximately <br />the same time as the Callahan project on the Madden property <br />at the northwest corner of Stanley Boulevard and Del Valle <br />Parkway (Stanley Boulevard), the applicant shall pay for <br />undergrounding from the eastern boundary of Tract 6382 up to <br />the first pole to the west of this property. The applicants <br />shall be eligible for reimbursement if other properties to the <br />west or across Stanley Boulevard develop. <br />17. Construction of residential units shall not commence until the <br />Pleasanton Unified School District indicates to the Planning <br />Director that adequate school capacity for the project- <br />generated children will be available at the time of occupancy. <br />18. The applicant shall record CC&R's for the project which shall <br />create a homeowner's association for the development. The <br />CC&R's shall be subject to the review and approval of the City <br />Attorney prior to recordation of the final map. The <br />homeowner's association shall be responsible for the <br />maintenance of the private street, the common area, and the <br />"Remainder" area. The homeowner's association shall merge <br />with the homeowner's associations created with Tract 6383 and <br />the future subdivision for the "Remainder" area. <br />
