That the proposed location of the conditional use <br />and the conditions under which it would be operated <br />or maintained will not be detrimental to the public <br />health, safety or welfare, or materially injurious <br />to the p properties or improvements in the <br />vicinity. <br />The proposal would provide adequate parking and <br />vehicular circulation to accommodate the subject <br />proposal. <br />3. That the proposed conditional use will comply with <br />each of the applicable provisions of this chapter. <br />As proposed and conditioned, each applicable <br />provision will be satisfied; and <br />WHEREAS, a Negative Declaration was previously prepared and <br />adopted for PUD-80-16-3M and PUD-80-16-7D. There have <br />been no changes in the project nor new information <br />concerning possible environmental effects. No further <br />environmental analysis is required; and <br />WHEREAS, the proposed use is consistent with the zoning <br />designation and General Plan policies of the City of <br />Pleasanton. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br />Section 1. Approves Case UP-90-46 the application of Pactel <br />Properties for a conditional use permit to allow the <br />establishment of a single-story, freestanding bank <br />located at the northwest corner of the Hopyard <br />Drive/Stoneridge Drive street intersection subject to the <br />conditions shown on Exhibit "A" attached hereto and made <br />part of this case by reference. <br />Section 2. This resolution shall become effective 15 days after <br />its passage and adoption unless appealed prior to that <br />time. <br />THIS RESOLIITION ADOPTED ON THE 14TH DAY OF NOVEMBER BY THE <br />FOLLOWING VOTE: <br />AYES: Commissioners Horan, Hovingh, Wright, Michelotti and <br />Chairman Mahern <br />NOES: None <br />ABSENT: None <br />ABSTAIN: Commissioner McGuirk <br />
