Resolution No. PC-90-104 Page 2 The project site is an in-fill parcel located within a developed commercial area. Public streets and other infrastructure are in place to serve the site. The applicant will make a contribution to the construction of improvements to the intersection of Hopyard Road and Owens Drive in order to maintain this intersection at mid LOS "D". The location and orientation of the various site features provide a logical and safe circulation pattern for customers and service vehicles between the site and Hopyard Road and Owens Drive. The design and operations of the car wash will not impact the nearby Allstar Inn. The four existing 12,000 gallon underground fuel storage tanks will be removed, soils will be tested for possible fuel contamination, removed if necessary, and replaced by clean fill. C. That the proposed conditional use will comply with each of the applicable provisions of this chapter. As proposed and conditioned, each applicable provision will be satisfied; and WHEREAS, a Negative Declaration was adopted for this project; and WHEREAS, the proposed use is consistent with the zoning designation and General Plan policies of the City of Pleasanton. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON RESOLVES THE FOLLOWING: Section 1. Approves Case UP-90-05, the application of Chevron USA for a conditional use permit to operate a gas station, food mart, and carwash located at 5280 Hopyard Road subject to the conditions shown on Exhibit "A" attached hereto and made part of this case by reference. Section 2. This resolution shall become effective 15 days after its passage and adoption unless appealed prior to that time.
