Resolution No. PC-90-104 <br />Page 2 <br />The project site is an in-fill parcel located <br />within a developed commercial area. Public streets <br />and other infrastructure are in place to serve the <br />site. The applicant will make a contribution to <br />the construction of improvements to the <br />intersection of Hopyard Road and Owens Drive in <br />order to maintain this intersection at mid LOS "D". <br />The location and orientation of the various site <br />features provide a logical and safe circulation <br />pattern for customers and service vehicles between <br />the site and Hopyard Road and Owens Drive. The <br />design and operations of the car wash will not <br />impact the nearby Allstar Inn. The four existing <br />12,000 gallon underground fuel storage tanks will <br />be removed, soils will be tested for possible fuel <br />contamination, removed if necessary, and replaced <br />by clean fill. <br />C. That the proposed conditional use will comply with <br />each of the applicable provisions of this chapter. <br />As proposed and conditioned, each applicable <br />provision will be satisfied; and <br />WHEREAS, a Negative Declaration was adopted for this project; and <br />WHEREAS, the proposed use is consistent with the zoning <br />designation and General Plan policies of the City of <br />Pleasanton. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br />Section 1. Approves Case UP-90-05, the application of <br />Chevron USA for a conditional use permit to operate a gas <br />station, food mart, and carwash located at 5280 Hopyard <br />Road subject to the conditions shown on Exhibit "A" <br />attached hereto and made part of this case by reference. <br />Section 2. This resolution shall become effective 15 days after <br />its passage and adoption unless appealed prior to that <br />time. <br />
