PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION N0. PC-90-104 <br />RESOLUTION APPROVING CASE UP-90-O5, THE APPLICATION OF CHEVRON <br />USA FOR A CONDITIONAL USE PERMIT <br />WHEREAS, Chevron USA has applied for a conditional use permit to <br />operate a gas station, food mart, and carwash located at <br />5280 Hopyard Road; and <br />WHEREAS, zoning for the property is C-F (Commercial Freeway) <br />District; and <br />WHEREAS, at their duly noticed public hearing of November 14, <br />1990, the Planning Commission considered all public <br />testimony, relevant exhibits and recommendations of the <br />City staff concerning this application; and <br />WHEREAS, the Planning Commission made the following findings: <br />A. That the proposed location of the conditional use <br />is in accordance with the objectives of the zoning <br />ordinance and the purpose of the district in which <br />the site is located. <br />The zoning ordinance states that the C-F zoning <br />district is to provide an area for commercial uses <br />catering to freeway travelers and tourists that <br />would enhance the appearance of entrances to the <br />City and that would protect motel patrons from <br />nuisances. The proposed uses consisting of a self- <br />serve gasoline station, convenience store, and car <br />wash are intended to cater to freeway travelers as <br />well as the business employees of the surrounding <br />commercial areas. The proposed building, site, and <br />landscape design are appropriate to the area and <br />will present an attractive entrance to the City. <br />The car wash air dryer includes noise controls so <br />that its nighttime operation will maintain interior <br />noise levels of the Allstar Inn to within General <br />Plan Noise Element standards. <br />B. That the proposed location of the conditional use <br />and the conditions under which it would be operated <br />or maintained will not be detrimental to the public <br />health, safety, or welfare, or materially injurious <br />to the properties or improvements in the vicinity. <br />
