Because of the non-conforming lot dimensions, <br />the property does not have the same amount of <br />usable side yard area in which to place the <br />covered carport as other lots which meet the <br />minimum development standards for the <br />applicable zoning district. <br />3) That the granting of the variance will not be <br />detrimental to the public health, safety or <br />welfare, or materially injurious to properties <br />or improvements in the vicinity. <br />Locating the carport 4 feet from the easterly <br />side yard property line would not be <br />detrimental to the privacy of the surrounding <br />area. With regards to compliance with Fire <br />and Building Codes, the Building Department <br />has conducted a code compliance site <br />investigation.
