PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COIINTY, CALIFORNIA <br />RESOLUTION N0. PC-90-98 <br />RESOLUTION APPROVING CASE UP-90-45, THE APPLICATION OF <br />CORNELIIIS J. DOHERTY FOR A CONDITIONAL USE PERMIT <br />WHEREAS, Cornelius J. Doherty has applied for a conditional use <br />permit to allow an auto rental business in an existing <br />commercial service complex located at 3657 Old Santa Rita <br />Road, Suite B; and <br />WHEREAS, zoning for the property is C-S (Commercial Service) <br />District; and <br />WHEREAS, at their duly noticed public hearing of October 24, 1990, <br />the Planning Commission considered all public testimony, <br />relevant exhibits and recommendations of the City staff <br />concerning this application; and <br />WHEREAS, the Planning Commission made the following findings: <br />A. That the proposed location of the conditional use <br />is in accordance with the objectives of the zoning <br />ordinance and the purpose of the district in which <br />the site is located. <br />One of the objectives of the zoning ordinance is to <br />ensure that public and private lands are used for <br />purposes which are beneficial to the City as a <br />whole. As conditioned, the proposed use would <br />provide a beneficial service to the community. The <br />proposed use can be accommodated on the project <br />site and is compatible with other commercial uses <br />within the immediate area. Although residential <br />units were subsequently constructed adjacent to <br />this commercial facility, there have not been any <br />adverse impacts resulting from its operations on <br />the residential units. <br />B. That the proposed location of the conditional use <br />and the conditions under which it would be operated <br />or maintained will not be detrimental to the public <br />health, safety, or welfare, or materially injurious <br />to the properties or improvements in the vicinity. <br />
