Resolution No. PC-90-93 <br />Page 2 <br />The proposed alcoholic beverage service and dance <br />club will be contained completely on-site. <br />Sufficient parking, traffic capacity and distance <br />from residential neighborhoods have been provided <br />and the site and building can accommodate the <br />proposed use. The proposed use operates during <br />hours which, and is located in an area where, <br />nighttime uses would not create a nuisance to <br />adjoining areas. Streets leading to the site are <br />designed per City standards and are signalized to <br />provide safe access into and out of the site. The <br />conditions of approval of the use permit, as well <br />as the applicant's design of the tenant space the <br />use will occupy, will ensure that the establishment <br />remains within the standards of all applicable City <br />codes. <br />C. That the proposed conditional use will comply with <br />each of the applicable provisions of the zoning <br />ordinance. <br />The site's PUD zoning permits the establishment of <br />dance clubs and bars, as defined by Municipal Code <br />Section 18.08.028. The proposed dance club <br />complies with all relevant sections of the zoning <br />ordinance. Granting a conditional use permit to Sh <br />Boom II, Inc. for serving alcoholic beverages after <br />10:00pm is consistent with the City's ability to <br />regulate zoning as listed in the Municipal Code <br />Section 18.124. <br />NHEREAB, the proposed use is consistent with the zoning <br />designation and General Plan policies of the City of <br />Pleasanton. <br />NON, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLONING: <br />Section 1. Approves Case UP-90-43, the application of Sh boom, <br />Inc., (Porter A. Hurt) for a conditional use permit to <br />operate a dance club which will serve alcoholic beverages <br />after 10:00pm at a facility proposed to be located at <br />4825 Hopyard Road subject to the conditions shown on <br />Exhibit "A" attached hereto and made part of this case by <br />reference. <br />Section 2. This resolution shall become effective 15 days after <br />its passage and adoption unless appealed prior to that <br />time. <br />
