PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION N0. PC-90-93 <br />RESOLUTION APPROVING A CONDITIONAL USE PERMIT AS FILED UNDER <br />CASE UP-90-43 FOR SH BOOM II, INC., PORTER A HURT, FOR A DANCE <br />CLUB <br />WHEREAS, SH Boom II, Inc., (Porter A. Hurt) has applied for a <br />conditional use permit to operate a dance club which will <br />serve alcoholic beverages after 10:00pm at a facility <br />proposed to be located at 4825 Hopyard Road; and <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) <br />- Industrial, Commercial and Offices District; and <br />WHEREAS, at their duly noticed public hearing of October 10, 1990, <br />the Planning Commission considered all public testimony, <br />relevant exhibits and recommendations of the City staff <br />concerning this application; and <br />WHEREAS, after considering all public testimony, relevant <br />exhibits, and recommendations of the City staff, the <br />Planning Commission approved a negative declaration for <br />Case UP-90-43; and <br />WHEREAS, the Planning Commission made the following findings: <br />A. That the proposed location of the conditional use <br />is in accordance with the objectives of the zoning <br />ordinance and the purposes of the district in which <br />the site is located. <br />The site of the proposed use is located in the <br />Hacienda Business Park's CPD (Retail/Commercial and <br />Financial Planned) District, which permits the uses <br />of the City's C-C (Central Commercial) District. <br />Bars, including entertainment and dancing, are a <br />conditionally permitted use in the C-C District and <br />are in accordance with the purposes of the zoning <br />district to provide locations to offer commodities <br />and services to the residents of Pleasanton and <br />surrounding areas. The use permit for the <br />alcoholic beverage service is, therefore, in <br />accordance with the objectives of the zoning <br />district. <br />B. That the proposed location of the conditional use <br />and the conditions under which it would be operated <br />or maintained will not be detrimental to the public <br />health, safety, or welfare, or materially injurious <br />to the properties or improvements in the vicinity. <br />
