Resolution No. 99-103 <br />Page Two <br /> <br />WHEREAS, written protests were filed and not withdrawn by at least one of the following: <br /> <br /> (a) at least 25% but less than 50% of the registered voters residing in the <br /> affected territory; or <br /> (b) at least 25% of the owners of land who also own at least 25% of the <br /> assessed value of land within the affected territory. <br /> <br />WHEREAS, Government Code Section 57100 et seq. requires that based on this level of <br /> protest, the voters residing within the annexation area must confirm the annexation <br /> through a special election. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: The City Council calls, provides for, and gives a special election by mail ballot on <br /> Tuesday, November 16, 1999. <br /> <br />Section 2: Identifies the affected territory as indicated in Exhibit A. <br /> <br />Section 3: Provides that the question of whether or not to annex to the City be put before the <br /> voters residing in the annexation area as follows: <br /> <br /> "Shall the order adopted on July 29, 1999, by the City Council of the City of <br /> Pleasanton ordering the annexation to the City of Pleasanton of the territory <br /> described in that order and designated as Happy Valley Annexation be confirmed? <br /> <br /> Yes <br /> <br /> No <br /> <br />Section 4: The terms or conditions of the annexation are as provided in LAFCo Resolution <br /> Nos. 99-01 and 99-02, attached as Exhibit B. <br /> <br />Section 5: The City Clerk is hereby authorized ad directed to certify the adoption of this <br /> resolution and to transmit a copy hereof to the Executive Director of LAFCo and <br /> request that an impartial analysis be prepared and adopted by September 16, 1999, <br /> as provided by Government Code Section 57144. <br /> <br /> <br />
