<br />1. Find that the project will not have a significant effect on the environment, and adopt the <br />resolution approving the Negative Declaration as shown in Exhibit E, and find that the <br />project has a De Minimis impact on the site's wildlife; <br /> <br />2. Find that the proposed major modification to the PUD Development Plan is consistent <br />with the General Plan and the purposes of the PUD Ordinance and that the proposed use <br />is consistent with the General Plan Land Use and South Livermore Valley Area Plan and <br />make the findings as identified in Exhibit H; <br /> <br />3. Adopt an Ordinance to approve PUD-93-02-08M, shown as Exhibit "C", subject to Con- <br />ditions of Approval listed in Exhibit "B-1"; <br /> <br />4. Find that the proposed use permit is consistent with the General Plan and make the find- <br />ings as identified in Exhibit I; <br /> <br />5. Adopt a Resolution to approve PCUP-181, as shown in Exhibit "D", subject to Condi- <br />tions of Approval listed in Exhibit "B-2". <br /> <br />SUMMARY: <br /> <br />The subject site is located adjacent to the Vineyard Avenue Corridor Specific Plan area. The <br />General Plan for this area encourages uses which relate to the outlying wine country and calls <br />for creating an attractive gateway to the Livermore Valley wine country and for implementing <br />wine country architectural and landscape design themes throughout the corridor. The proposed <br />event center and winery facility is consistent with the South Livermore V alley Area Plan, and by <br />classifying the proposed facility as a conditional use, the City would have control over the <br />operational aspects of the use, ensuring that potential issues such as noise, parking, and traffic <br />can be controlled. Staff and the applicant have worked with Ruby Hill homeowners to refine the <br />plan and to reduce impacts on the neighborhood. <br /> <br />Honorable Mayor and Members of the City Council: <br /> <br />BACKGROUND <br /> <br />The subject site is located within the Ruby Hill Planned Unit Development (PUD-93-02). The <br />overall development was originally approved by the Alameda County before it was annexed to <br />the City of Pleasant on. Development of the site is subject to the County's planned development <br />conditions of approval and the Ruby Hill Development Agreement.
