<br />The City of Livermore commented on the proposed development. Its concerns were focused on: <br />I) the proposed development would be connected to the City of Livermore sewage system, and <br />2) impact on local traffic. The applicant has already contacted the City of Livermore in terms of <br />sewer connection and fees. Due to the Route 84 widening project, a sliver ofthe land on the <br />subject parcel, approximately 1,800 square feet in size located at the corner of Vineyard Avenue <br />and Isabel A venue, would need to be dedicated to the widening project. The applicant is aware <br />of it. Staff has included conditions of approval addressing these two items. <br /> <br />PLANNING COMMISSION RECOMMENDATION <br /> <br />The Planning Commission unanimously recommended approval of PUD-93-02-08M/PCUP-180 <br />to the Council City. A group of Ruby Hill residents, many of them the closest neighbors to the <br />proposed facility, spoke in support of the facility and requested that additional conditions be <br />added concerning noise, operation hours, lighting in the parking area, etc. One Ruby Hill resi- <br />dent spoke against the project. After lengthy discussion, the Planning Commission amended the <br />conditions of approval as proposed by staff. The applicant accepted the amendments, and the <br />majority of the nearest residents found the amendments were appropriate. <br /> <br />PUBLIC NOTICE <br /> <br />Notices of the City Council's public hearing on this item were sent to the homeowners located in <br />Ruby Hill and within 1,000-feet of the subject property. Staff has not received any further <br />comments pertaining to the proposed project as of the time the staff report was written. <br /> <br />PUD DEVELOPMENT PLAN FINDINGS <br /> <br />The Pleasanton Municipal Code sets forth the purposes of the Planned Unit Development (PUD) <br />District and the considerations to be addressed in reviewing a PUD development plan proposal <br />or modifications of an approved development plan. Although the requested modification would <br />not alter the agricultural/viticulture uses or alter the allowed building envelop on the subject site, <br />it would allow an event center and winery facility as part ofthe Ruby Hill PUD. The City <br />Council must make findings that the proposed PUD major modification conforms to the pur- <br />posed of the PUD District, before making its action. These findings are listed in Exhibit H. <br /> <br />CONDITIONAL USE PERMIT FINDINGS <br /> <br />The proposed event center and winery facility is consistent with the South Livermore Valley <br />plan. Staff believes that it is appropriate to classify the proposed development as a conditional <br />use to allow the City to have control over the operational aspects ofthe use, ensuring that poten- <br />tial issues such as noise, parking, and traffic can be controlled.
