Ordinance No. Page Two WHEREAS, at its meeting of October 18,2006, the Planning Commission recommended approval of the modification to the PUD development plan; and WHEREAS, a duly noticed public hearing was held on December 5, 2006; and WHEREAS, the City Council finds that the PUD major modification is consistent with the General Plan policies and the purposes of the PUD ordinance of the City of Pleasant on; and NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS FOLLOWS: Section 1. Approves Case PUD-99-07-03M/PDR-579, the application of Donald Babbitt/Heartwood Communities for: (1) a major modification to the approved Planned Unit Development (PUD) development plan for Tract 7162 (formerly TTK Properties) to incorporate design guidelines for the development and to modify the design review approval process; and (2) design review approval for the construction of an approximately 7, 128-square-foot two-story home with an approximately 1,668-square-foot garage and a 1,088-square-foot basement to be located on Lot 8, on the south side of Happy Valley Road at its junction with Alisal Street in the Happy Valley Specific Plan area, subject to the conditions shown on Exhibit B, attached hereto and incorporated herein by this reference. Section 2. A summary of this ordinance shall be published once within fifteen (15) days after its adoption in "The Valley Times," a newspaper of general circulation published in the City of Pleasant on, and the complete ordinance shall be posted for fifteen (15) days in the City Clerk's office within fifteen (15) days after its adoption. Section 3. This ordinance shall be effective thirty (30) days after its passage and adoption, INTRODUCED at a regular meeting of the City Council of the City of Pleasanton on December 5, 2006.
