<br />Ordinance No. <br />Page Two <br /> <br />WHEREAS, at its meeting of October 18,2006, the Planning Commission recommended <br />approval of the modification to the PUD development plan; and <br /> <br />WHEREAS, a duly noticed public hearing was held on December 5, 2006; and <br /> <br />WHEREAS, the City Council finds that the PUD major modification is consistent with <br />the General Plan policies and the purposes of the PUD ordinance of the <br />City of Pleasant on; and <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br />HEREBY ORDAIN AS FOLLOWS: <br /> <br />Section 1. Approves Case PUD-99-07-03M/PDR-579, the application of Donald <br />Babbitt/Heartwood Communities for: (1) a major modification to the <br />approved Planned Unit Development (PUD) development plan for <br />Tract 7162 (formerly TTK Properties) to incorporate design guidelines for <br />the development and to modify the design review approval process; and <br />(2) design review approval for the construction of an approximately <br />7, 128-square-foot two-story home with an approximately 1,668-square-foot <br />garage and a 1,088-square-foot basement to be located on Lot 8, on the <br />south side of Happy Valley Road at its junction with Alisal Street in the <br />Happy Valley Specific Plan area, subject to the conditions shown on <br />Exhibit B, attached hereto and incorporated herein by this reference. <br /> <br />Section 2. A summary of this ordinance shall be published once within fifteen (15) <br />days after its adoption in "The Valley Times," a newspaper of general <br />circulation published in the City of Pleasant on, and the complete ordinance <br />shall be posted for fifteen (15) days in the City Clerk's office within <br />fifteen (15) days after its adoption. <br /> <br />Section 3. This ordinance shall be effective thirty (30) days after its passage and <br />adoption, <br /> <br />INTRODUCED at a regular meeting of the City Council of the City of Pleasanton on <br />December 5, 2006. <br />
