<br />EXHIBIT C <br /> <br /> <br />CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />ORDINANCE NO. <br /> <br />AN ORDINANCE APPROVING THE APPLICATION OF DONALD <br />BABBITT/ HEARTWOOD COMMUNITIES FOR PLANNED UNIT <br />DEVELOPMENT MAJOR MODIFICATION AND DESIGN REVIEW <br />APPROVAL, AS FILED UNDER CASE PUD-99-07-03M/ PDR-579 <br /> <br />WHEREAS, Donald Babbitt/Heartwood Communities has applied for: (1) a major <br />modification to the approved Planned Unit Development (PUD) <br />development plan for Tract 7162 (formerly TTK Properties) to incorporate <br />design guidelines for the development and to modifY the design review <br />approval process; and (2) design review approval for the construction of an <br />approximately 7, 1 28-square-foot two-story home with an approximately <br />1,668-square-foot garage and a 1,088-square-foot basement to be located on <br />Lot 8, on the south side of Happy Valley Road at its junction with Alisal <br />Street in the Happy Valley Specific Plan area; and <br /> <br />WHEREAS, zoning for the property is PUD-SRDR (Planned Unit Development- <br />Semi-Rural Density Residential) District; and <br /> <br />WHEREAS, the environmental review for this proposed project was undertaken with the <br />Final Environmental Impact Report (EIR) for the Happy Valley Specific <br />Plan, approved by the City Council on June 16, 1998, in conformance with <br />the standards of the California Environmental Quality Act (CEQA); and <br /> <br />WHEREAS, there are no substantial changes to the project or to the circumstances under <br />which the project is being undertaken that involve new significant <br />environmental effects or that substantially increase the severity of <br />previously identified effects; furthermore, there is no new information of <br />substantial importance which was unknown at the time that the Mitigated <br />Negative Declaration was approved by the City Council regarding the <br />project or its effects, mitigation measures, or alternatives; and any <br />previously identified effects or impacts are mitigated to a level of <br />insignificance with the mitigation measures incorporated into the project's <br />design or imposed on the project pursuant to the conditions of approval; <br />and <br />
