Box 520 <br />Pleasanton, CA 94566-0802 <br /> <br />RE: Sbadow Cliffs Regional Recreation Area <br />Yolanda Court <br /> <br />Dear Marion: <br /> <br />The East Bay Regional Park District staff has reviewed the request for a variance to <br />the height limit on the adjacent Yolanda Court area. The Park District is concerned <br />that a condition of approval, which was a compromise on the Park District's part to <br />provide for more design flexibility, was established to help reduce the impacts on the . <br />Regional Recreation Area. The buyers of the property had full knowledge of the <br />condition and its height limits. It was a mistake to also approve building sizes up to <br />4,200 square feet with building envelopes (front, side, and rear yard set backs and <br />height limit) that would not accommodate that size. Now the Park District, who is the <br />manager of the public's land, is being requested to further compromise in order to <br />accommodate the allowed maximum size house. <br /> <br />The Park District understands that the architect has tried to address his client's desires <br />while trying to stay within the confines of the building envelope. On the Renquist's <br />residence a 10' portion of the home would exceed the 23' height limitation by 2 V. <br />feet. It is also understood that there will be two other homes that would like to have <br />variances for the height limit as well. <br /> <br />The Park District will need to review each proposed variance on a case by case basis. <br />The increase in height must be mitigated by planting additional trees on the adjacent <br />Park District land to help screen the building mass. The review and mitigation <br />process includes: <br />. Submitted plans and story poles must be reviewed by the Park District. Story <br />poles will need to be placed on the site for review. Plans are to include an <br />existing tree survey with size and type of tree, and a proposed planting <br />schedule, <br />. The property owner shall retain an encroachment pennit from the Park <br />District prior to any planting.
