Resolution No. 92-159 <br />Page Two <br /> <br />~ecti__on 3: <br /> <br /> In addition to development fees in effect at the time <br />each building permit is issued, each the following <br />developers shall pay a fee of $2,200 per dwelling unit <br />at the time a building permit is issued for each unit <br />to offset the cumulative cost of capital facilities <br />made necessary by ongoing residential development: <br />Ruby Hill, Oak Tree Farm, Hirst/Tong, West View, <br />Marsh/Smith, Kaufman and Broad, Shabazian, and <br />Chu/Gahramat; the Moller Project, pursuant to prior <br />agreement, shall pay $2,100 per dwelling unit. <br /> <br />Section 4: <br /> <br />Effect of Approval. <br /> The effect of these growth management approvals <br /> shall be to permit development in accordance with <br /> Chapter 17.36 of the Pleasanton Municipal Code, <br /> with the other terms and conditions set forth in <br /> this resolution, and with the terms and conditions <br /> of Growth Management Agreements authorized by this <br /> resolution. <br /> <br />be <br /> <br />This resolution does not guarantee the <br />availability of sufficient sewage treatment <br />capacity to serve the projects which have received <br />growth management approval. Building permits may <br />be withheld if the city determines that sewage <br />treatment capacity is not available at the time <br />building permits for the Project are applied for. <br /> <br />This resolution also does not guarantee the <br />availability of sufficient water to serve the <br />Project; building permits for the Projects <br />identified in Section 3 may be withheld if the <br />City determines that sufficient water is not <br />available, as evidenced by mandatory water <br />rationing, at the time building permits for the <br />Project are applied for. <br /> <br />Section 5: Nothing herein shall lessen any obligation of a <br /> developer required as a condition of any other <br /> approvals granted by the city. <br /> <br />Section 6: The City Manager is hereby authorized to sign Growth <br /> ~Management Agreements with the respective property <br /> owners/developers in order to carry out the terms and <br /> conditions of this resolution. <br /> <br /> <br />
