CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 92-152 <br /> <br />RESOLUTION GRANTING THE APPEAL OF MICHAEL D. <br />SCHIBLER (CASE AP-92-10) AND APPROVING A <br />VARIANCE FOR A FENCE IN A STREET SIDE YARD <br />(CASE V-92-07) <br /> <br />WHEREAS, <br /> <br />at a meeting of May 4, 1992, the Zoning Administrator <br />denied Case V-92-07, the application of Michael D. <br />Schibler for a variance from the Municipal Code setback <br />requirements for a fence in a street side yard at a <br />residence located at 4298 Fairlands Drive; and <br /> <br />WHEREAS, <br /> <br />zoning for the property is R-1-6500 (Single Family <br />Residential - Minimum 6,500 sq. ft. Lot Size); and <br /> <br />WHEREAS, <br /> <br />within the time specified by the Pleasanton Municipal <br />Code, the applicant submitted an appeal to the City Clerk <br />of the City of Pleasanton; and <br /> <br />WHEREAS, <br /> <br />a public hearing was held before the City Council on <br />July 21, 1992, at which time all pertinent testimony and <br />documents were reviewed; and <br /> <br />WHEREAS, <br /> <br />after a review of the material presented, the City <br />Council makes the following findings: <br /> <br />ae <br /> <br />That because there are special circumstances having <br />to do with the efficient utilization of the subject <br />property, the strict application of the provisions <br />of the Code would deprive the property owner of <br />privileges enjoyed by other properties in the <br />vicinity and under identical zoning classification. <br /> <br />be <br /> <br />That because of the special circumstances mentioned <br />in paragraph (a) above, the granting of the <br />variance will not constitute a grant of special <br />privilege inconsistent with the limitation on other <br />properties classified in the same zoning district. <br /> <br />That the granting of the variance will not be <br />detrimental to the public health, safety, or <br />welfare, or materially injuries to properties or <br />'improvements in the vicinity; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br /> <br />
