CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 92-152 RESOLUTION GRANTING THE APPEAL OF MICHAEL D. SCHIBLER (CASE AP-92-10) AND APPROVING A VARIANCE FOR A FENCE IN A STREET SIDE YARD (CASE V-92-07) WHEREAS, at a meeting of May 4, 1992, the Zoning Administrator denied Case V-92-07, the application of Michael D. Schibler for a variance from the Municipal Code setback requirements for a fence in a street side yard at a residence located at 4298 Fairlands Drive; and WHEREAS, zoning for the property is R-1-6500 (Single Family Residential - Minimum 6,500 sq. ft. Lot Size); and WHEREAS, within the time specified by the Pleasanton Municipal Code, the applicant submitted an appeal to the City Clerk of the City of Pleasanton; and WHEREAS, a public hearing was held before the City Council on July 21, 1992, at which time all pertinent testimony and documents were reviewed; and WHEREAS, after a review of the material presented, the City Council makes the following findings: ae That because there are special circumstances having to do with the efficient utilization of the subject property, the strict application of the provisions of the Code would deprive the property owner of privileges enjoyed by other properties in the vicinity and under identical zoning classification. be That because of the special circumstances mentioned in paragraph (a) above, the granting of the variance will not constitute a grant of special privilege inconsistent with the limitation on other properties classified in the same zoning district. That the granting of the variance will not be detrimental to the public health, safety, or welfare, or materially injuries to properties or 'improvements in the vicinity; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS:
