<br />Ordinance No. 1939 <br />Exhibit B <br /> <br />34. Trees used in landscaping shall be a minimum 24-inch box size. The applicant <br />shall pay a fee in the amount of the appraised value less the value of the 24-inch <br />box or replant at a ratio to exhaust the appraised value. All shrubs a minimum of <br />five (5) gallons, unless otherwise conditioned or shown on the approved landscape <br />plan. <br /> <br />35. The project developer shall provide root control barriers and four inch (4") <br />perforated pipes for the street trees. <br /> <br />36. All landscaping indicated on the plans shall be installed by the applicant! <br />homeowner upon occupancy. The landscaping plan for the rear yards shall be <br />submitted for review and approval by the Planning Director. Rear yard <br />landscaping shall be installed within nine (9) months of the occupancy. The <br />applicant shall arrange a landscaping site inspection with the Planning Department <br />staff upon completion of the landscaping installation. <br /> <br />Biological Assessment <br /> <br />37. The applicant shall strictly following the recommendations stated in the Biological <br />Assessment report prepared by WRA, included in Exhibit A, on file with the <br />Planning Department. <br /> <br />38. All construction shall be scheduled outside the bird-breeding season (February <br />through August). In an event that the construction cannot be scheduled outside the <br />bird-breeding season, a wildlife biologist shall be contracted at the owner's <br />expense to conduct a breeding bird survey within thirty (30) days of the scheduled <br />construction to determine if nesting birds are present. The wildlife biologist shall <br />provide a letter stating that no nesting birds are present prior to commencement of <br />construction. <br /> <br />If nesting birds are observed, the wildlife biologist shall recommend mitigation <br />measures to minimize the construction disturbance to the nest birds. Mitigations <br />may include but are not limited to establishing buffers no less than fifty (50) feet <br />from active nests until young birds have fledged the nest. The written mitigations <br />shall be submitted to the Planning Director for review and approval prior to <br />commencement of construction. <br /> <br />39. The applicant shall collect and store seeds until it is time to reseed. Seed <br />collection shall be in accordance with the WRA report for species. <br /> <br />7 <br />
