The project developer shall submit the subdivision improvement plans to Joseph McNeil, <br />consulting arborist, for review in order to determine that site-specific measures required <br />to preserve the existing trees designated for preservation during construction are being <br />implemented with the plans. The consultant's comments shall be submitted to the <br />Planning Director and to the City's Landscape Architect and shall be incorporated onto <br />the final improvement plans prior to issuance of a grading, on-site, and/or building <br />permits. <br /> <br />28. The Planning Director shall review and approve the arborist's recommendations for the <br />continual tree care on each lot. <br /> <br />29. No trees shall be removed other than those specifically designated for removal in the <br />tree report approved by the City Council. However, no trees shall be removed for <br />aesthetic reasons unless it is dead, poses a safety hazard, or improves the health of the <br />woodland, as determined by the City Landscape Architect. The project developer shall <br />post cash, letter of credit, or other security satisfactory to the Planning Director in the <br />amount of five thousand dollars ($5,000) for each tree required to be preserved, up to a <br />maximum of twenty-five thousand dollars ($25,000). This cash bond or security shall be <br />retained for one year following completion of subdivision improvements and shall be <br />forfeited if the trees are removed, destroyed, or disfigured. For trees that are removed, <br />destroyed, or disfigured during construction, the applicant shall pay a fine in the amount <br />equal to the appraised value of the subject tree. If the fine based on the appraised value <br />of the tree(s) exceeds the bond amount, the applicant shall pay the difference between <br />the bond and the appraised value of the subject tree(s). <br /> <br />30. Prior to construction, temporary six-foot tall chain link fencing or other fence type <br />acceptable to the Planning Director shall be installed around the existing trees to be <br />saved. The final location of said fencing shall be subject to the review and approval of <br />the Planning Director. Fencing shall remain in place until final inspection by the <br />Planning Department; removal of said fencing prior to that time may result in a "stop <br />work" order. In addition, the following tree preservation methods shall be followed for <br />the existing trees to be preserved: <br /> <br />a. The applicant shall utilize his best efforts to locate any new utility trenches <br />outside the dripline of the existing trees to be saved. If this is not feasible, then <br />the applicant shall submit a report from a certified arborist acceptable to the City <br />that indicates the trenching will not be detrimental to the health of the trees. <br /> <br />b. No oil, gasoline, chemicals, or other harmful materials shall be deposited or <br />disposed within the dripline of the trees or in drainage channels, swales, or areas <br />that may lead to the dripline. <br /> <br />c. No signs, wires, or ropes shall be attached to the trees. <br /> <br />d. No stockpiling/storage of construction materials, fill, etc., shall take place <br />underneath or within 5' of the dripline of the existing trees. <br /> <br />e. No equipment or temporary structures shall be placed within or beneath the <br />dripline of the existing trees. <br /> <br />8 <br />
