<br /> <br />CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />ORDINANCE NO. 1936 <br /> <br />AN ORDINANCE APPROVING THE APPLICATION OF KAZUO AND TAKIKO <br />HATSUSHI FOR PUD DEVELOPMENT PLAN APPROVAL <br />AS FILED UNDER CASE PUD-99-14 <br /> <br />WHEREAS, Kazuo and Takiko Hatsushi have applied for Planned Unit Development (PUD) <br />development plan approval of a new development consisting of 13 new single-family <br />custom lots and one existing single-family home on an approximately 15-acre site lot <br />located at 2756, 2770, and 2798 Vineyard Avenue within the Vineyard Corridor <br />Specific Plan Area; and <br /> <br />WHEREAS, zoning for the property is PUD-LDR and OS (Planned Unit Development - Low <br />Density Residential and Open Space) District; and <br /> <br />WHEREAS, the environmental review for the proposed project was undertaken with the Final <br />Environmental Impact Report (EIR) for the Vineyard A venue Corridor Specific Plan, <br />certified by the City Council on March 1999, in conformance with the standards of the <br />California Environmental Quality Act (CEQA); and there are no substantial changes to <br />the project or the circumstances under which the project is being undertaken that <br />involve new significant environmental effect or that substantially increase the severity <br />of previously identified effects; furthermore, there is no new information of substantial <br />importance which was unknown at the time that the EIR was approved by the City <br />Council regarding the project or its effects, mitigation measures, or alternatives, and any <br />previously identified effects or impacts are mitigated to a level of insignificance, with <br />the mitigation measures incorporated into the project's design or imposed on the project <br />pursuant to the conditions of approval; and <br /> <br />WHEREAS, the Council received the Planning Commission's recommendations for approval of <br />development plan; and <br /> <br />WHEREAS, a duly noticed public hearing was held on June 20, 2006; and <br /> <br />WHEREAS, the City Council finds that the development plan and site development standards are <br />consistent with the General Plan, the Vineyard A venue Corridor Specific Plan, and the <br />purposes of the PUD ordinance. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY <br />ORDAIN AS FOLLOWS: <br />
