<br />EXHIBIT B <br />DRAFT CONDITIONS OF APPROVAL <br /> <br />PADR-1338IPV-131, Dustin Boyce <br />4546 Second Street <br />October 17, 2006 <br /> <br />1. The proposed development shall be in substantial conformance to the development <br />plans and related materials, Exhibit A, dated "Received, July 25, 2006", on file with <br />the Planning Department, except as modified by the following conditions. Minor <br />changes to the plans may be allowed subject to the approval of the Planning <br />Director if found to be in substantial conformance to the approved exhibits. <br /> <br />2. The plan check materials will be accepted only after the completion of the variance <br />and design review procedures' 15-day appeal period, unless the applicants submit a <br />signed statement acknowledging that the plan check fees may be forfeited in the <br />event that the approval is overturned or the design is significantly changed as the <br />result of an appeal. In no case will a building permit be issued prior to the <br />expiration of the 15-day appeal period. <br /> <br />3. All conditions of approval for this case shall be written by the project developer on <br />all building permit plan check sets submitted for review and approval. These <br />conditions of approval shall be on, at all times, all construction plans kept on the <br />project site. It is the responsibility of the property owner to ensure that the project <br />contractor is aware of, and abides by, all conditions of approval. Prior approval from <br />the Planning Department must be received before any changes are constituted in site <br />design, grading, building design, building colors or materials, etc. <br /> <br />4. All mitigation measures recommended in the Arborist Report dated September 19, <br />2006 shall be followed. <br /> <br />5. Prior to submittal to the Building Department, the applicant shall submit to the <br />Planning Department a determination by a City approved consulting arborist, the <br />value of the two heritage trees located on 4524 Second Street and the one heritage <br />tree located at 4558 Second Street. <br /> <br />6. Prior to issuance of building permits, the applicant or project developer shall <br />provide an appropriate security/ bonds for the two heritage trees located on 4524 <br />Second Street and the one heritage tree located at 4558 Second Street as identified <br />in the Arborist letter dated "September 19, 2006". The project developer shall post <br />cash, letter of credit, or other security satisfactory to the Planning Director and/or <br />the City Attorney in the amount not less equal to the value of each tree, but not less <br />than $5,000.00 for each tree should any work, utilities or otherwise, be conducted <br />
