<br />Resolution No, 06- <br />Page Two <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1. Approvcs the Negative Declaration for the application of Charles Austin and Scott <br />Austin (1) Gencral Plan amendment to change the land use designation of an <br />approximately 30-acre hillside property locatcd at 3459 Old Foothill Road from <br />Rural Density Residential (1 du/5 ac) to Low Dcnsity Residential (<2 dulac) on <br />approximately eight acres with a maximum of eight units and to Agriculture and <br />Grazing land uses on the remaining 22 acrcs; and (2) PUD rezoning and <br />dcvelopmcnt plan approval to rczone the property from A (Agriculture) District to <br />PUD-LDR (Planncd Unit Development - Low Density Residential) District on <br />eight acres and to PUD-AG (Planned Unit Development - Agriculturc and Grazing) <br />Districts on thc remaining 22 acrcs, and to subdivide thc subjcct property into eight <br />custom home sites and to designate the rcmaining 22 acres for permanent open <br />spacc, <br /> <br />Section 2, Thc City staff is directed to cause a Notice of Determination to be filed pursuant to <br />Section 5.4(g) of Resolution No, 77-66. <br /> <br />Section 3, This rcsolution shall become effectivc immediately upon its passage and adoption. <br /> <br />I HEREBY CERTIFY THAT THE FOREGOING WAS DULY AND <br />REGULARL Y ADOPTED BY THE CITY COUNCIL OF THE CITY OF PLEASANTON, AT <br />A MEETING HELD ON OCTOBER 17, 2006, BY THE FOLLOWING VOTE: <br /> <br />AYES: <br />NOES: <br />ABSENT: <br />ABSTAIN: <br /> <br />Councilmembers <br /> <br />ATTEST: <br /> <br />Karen Diaz, City Clerk <br /> <br />APPROVED AS TO FORM: <br /> <br />Michael H, Roush, City Attorncy <br />
