<br /> <br />CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO, 06- <br /> <br />RESOLUTION APPROVING A NEGATIVE DECLARATION <br />FOR THE APPLICATION OF CHARLES AUSTIN AND SCOTT AUSTIN <br />FOR GENERAL PLAN AMENDMENT AND PUD REZONING AND <br />DEVELOPMENT PLAN APPROVAL, AS FILED UNDER CASE PGPA-ll/PUD-58 <br /> <br />WHEREAS, at its meeting of October 17, 2006, the City Council rcccived a proposed Negative <br />Declaration for the application of Charlcs Austin and Scott Austin for: (l) General <br />Plan amcndmcnt to change the land use designation of an approximately 30-acre <br />hillside property located at 3459 Old Foothill Road from Rural Density Residential <br />(I dul5 ac) to Low Density Residential (<2 dulac) on approximately cight acrcs <br />with a maximum of eight units and to Agriculturc and Grazing land uses on the <br />remaining 22 acrcs; and (2) PUD rezoning and developmcnt plan approval to rezone <br />the property from A (Agriculturc) District to PUD-LDR (Planned Unit <br />Development - Low Density Residential) District on eight acres and to PUD-AG <br />(Planned Unit Dcvclopmcnt - Agriculture and Grazing) Districts on thc remaining <br />22 acrcs, and to subdivide thc subjcct propcrty into eight custom homc sitcs and to <br />designate the remaining 22 acres for permanent open space; and <br /> <br />WHEREAS, the City Council rcceivcd and reviewed the Initial Study, datcd Junc 7, 2006 and <br />reccivcd thc recommendations of staff and thc Planning Commission; and <br /> <br />WHEREAS, a duly noticed public hearing was held on Octobcr 17, 2006, at which time the <br />public was given the opportunity to commcnt on thc environmental impacts of the <br />proposed projcct; and <br /> <br />WHEREAS thc City Council has reviewed the potential impacts in accordance with the <br />applicablc statc and local guidelines governing the preparation ofNegativc <br />Dcclarations and Environmcntallmpact Rcports; and <br /> <br />WHEREAS the City Council finds that the proposed project would not havc any significant <br />adversc cffccts on the environment; and <br /> <br />WHEREAS the City Council further finds that the proposed project will havc no potcntial for <br />advcrse impacts on the sitc's wildlifc, <br />
