<br />Honorable Mayor and Members of the City Council: <br /> <br />BACKGROUND <br /> <br />The proposed lot line adjustment is located on Lot 18 of the Vineyard Avenue Corridor Specific <br />Plan (Hahner Property). In March 2001, the City approved a Planned Unit Development Plan <br />(Case PUD-00-01) submitted by Mardel LLC to allow the construction of 38 single-family <br />detached homes, a public sewer lift station, realignment of Vineyard Avenue, creation of a <br />vineyard estate lot and other public infrastructure in accordance with the Vineyard Avenue <br />Corridor Specific Plan. In March 2003, Mark Arola and Jon McCurdy modified PUD-OO-OI to <br />allow 4.2 acres to be developed separately. <br /> <br />In October 2003, the City Council approved a final map for Tract 7240 (Chateau Country <br />Estates), which subdivided the remaining portions of PUD-00-01, creating 30 single-family <br />residential lots, one existing home site, one vineyard estate lot and two parcels dedicated to the <br />City as open space. The current owner of Tract 7240 is GHC Company 7, a Delaware limited <br />liability company, which is managed by Greenbriar Homes Communities. <br /> <br />The two parcels which were dedicated to the City for open space are Parcels C and D of Tract <br />7240. Notwithstanding that Parcels C and D are owned by the City, these parcels, as well as <br />other street landscaping, project trees, and Vineyard Corridor landscaping, are privately <br />maintained pursuant to a License and Landscaping Maintenance Agreement between the City and <br />GHC dated April 2005. The requirement for such private maintenance of the City parcels and <br />other landscaping was a condition of approval for Tract 7240. <br /> <br />PROPOSED LOT LINE ADJUSTMENT <br /> <br />GHC now requests that 2,658 square feet of the City-owned Parcel C (which has a total of 19,419 <br />square feet) be transferred via a lot line adjustment to Parcel A, the private vineyard estate lot <br />(which has a total of 17.6 acres). GHC makes this request because there is an existing water well <br />on Parcel C which GHC would like to use to irrigate the vineyards required to be planted and <br />maintained on Parcel A. While there is another existing water well on Parcel A, that well does <br />not have sufficient capacity to water the required 15.6 acres of vineyards. <br /> <br />The Vineyard Avenue Corridor Specific Plan supports GHC's proposed use of well water to <br />irrigate the vineyards on Parcel A. Specifically, the Public Facilities section provides, in relevant <br />part: <br /> <br />Water Conservation Partial mItIgation of the cumulative Increase In <br />potable water demand will be provided by the following... <br /> <br />Well water shall be required for irrigation of vineyards and related <br />agricultural uses.
