Resolution No. 92-104 <br />Page Three <br /> <br />Acquire scenic/conservation easements for private <br />open space areas possessing exceptional natural, <br />scenic, and/or vegetation or wildlife habitat <br />qualities. Maintenance and liability should be <br />the responsibility of the property owner. <br /> <br />Landscaping located within the public right-of-way <br />between private developments and the fronting <br />street curb or pavement edge, excluding areas in <br />front of soundwalls, should be maintained by the <br />private owner. Landscaping located within the <br />public right-of-way between soundwalls and the <br />fronting street curb or pavement edge which does <br />not exceed City maximum maintenance cost standards <br />should be maintained by the City. Landscaping in <br />front of soundwalls which does exceed City maximum <br />maintenance cost standards should be maintained by <br />the private owner. Soundwalls should be <br />maintained by the private owner. Landscape <br />islands within the public right-of-way should be <br />maintained by the City. <br /> <br />e <br /> <br />Private open space areas should be maintained by <br />the owner or a homeowners' association, unless: <br />1) the maintenance of substantial public amenities <br />justifies the formation of a landscaping and <br />lighting maintenance district; or 2) a homeowners' <br />association is otherwise not needed, and a <br />landscaping and lighting maintenance district is <br />established in its place, with maintenance and <br />administrative costs to be paid by the owner(s). <br /> <br />Standards: <br /> <br />Minimum width of restricted trail easements should <br />be 20 feet. Minimum width of regular trail <br />easements should be 100 feet. <br /> <br />Trail use should be generally limited to <br />pedestrians, equestrians, and bicyclists. <br />feasible, trails should be made usable for <br />disabled persons. <br /> <br />Where <br /> <br />Require a buffer zone around and maintained by the <br />private property owner(s) for any dedicated open <br />space adjacent to existing or proposed <br />development. <br /> <br /> <br />
