Resolution No. 92-81 <br />Page Two <br /> <br />WHEREAS, <br /> <br />the City Council determined that the appearance of the <br />facility is unattractive and adversely affects the <br />general welfare of the surrounding area. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: Denies Case AP-92-8, the appeal of William Moss, <br /> thereby upholding the decision of the Planning Commission <br /> revoking the conditional use permit of William Moss for <br /> a small recycling collection facility located at 2803 <br /> Hopyard Road due to failure to comply with conditions of <br /> approval. <br /> <br />Section 2: <br /> <br /> The City Clerk shall forward a certified copy of this <br />resolution to the appellant with a notice that he has <br />ninety (90) days following the date of adoption of this <br />resolution in which to seek judicial review of this <br />action of the city Council. <br /> <br />Section 3: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br /> I HEREBY CERTIFY THAT THE FOREGOING WAS DULY AND <br />REGULARLY ADOPTED BY THE CITY COUNCIL OF THE CITY OF PLEASANTON, AT <br />A MEETING HELD ON APRIL 21, 1992 BY THE FOLLOWING VOTE: <br /> <br />AYES: <br />NOES: <br />ABSENT: <br />ABSTAIN: <br /> <br />Councilmembers - Mohr, Scribner, Tarver, and Mayor Mercer <br />None <br /> <br />Councilmember Butler <br />None <br /> <br />Michael H.
