,..,.'

.

.
EXHIBIT D

7/7/06

Appeal for the case PADR-1542, Additions
Attach to APPLICATION FOR DEVELOPMENT REVIEW for: H Description of Proposal

POINTS OF DISCUSSION:

Isn't intent of Pleasant on's Citv Code Section 13,32.010 and etc. Codes for vrivacv, open space
protection, eet. and doesn't it apply in this situation?

1, New balconv in second story appears to be 4' out X 9' wide (large enough for chairs,
etc,) and clearly invades privacy of residents living at 3116 Joanne Circle by a direct
a. The master bedroom dressing area & bedroom sliding glass door & window
next to the bed in the master bedroom
b. The kitchen sink, dining nook & part of the family room
c, The patio area between the master bedroom & family room

2, The proposed windows in the second story are large 4' wide x 5'high, which were not
used by original builder, The windows will be in line of sight into the personal living
space of:
a, The living space as noted in # 1.

3, The proposed glass sliding door that is part of the new balcony will look
a, Directly into the private/personalliving space as noted in #1,

Note: Mr. Rhoades built a raised deck with a "hot tub" to go with his pool area. This
plaeed a reduction of adequate privacy to 3116 Joanne Circle which is
directly behind Mr, Rhoades house. Initially, the builder had elevations and
land grades so that the common line backline fence would minimize any
privacy issues between the two properties. This additional 2nd story will
finalize any ability to have any privacy at all for the propertv at 3116 Joanne
Circle.

Isn't intent of Pleasant on's City Code Section 13.32,010 and etc, Codes for vrivacv. oven svace
protection, ect. and doesn't it apply in this situation?

4, Because the sun rises in the East, the large windows and large sliding glass door
will refleet the sun's glare during at least 6 months of the year for a period
of3 or more hours daily & especially if the windows are reflective glass.

5, Second story houses originally built in this tract do not have backvard balconies & 4'
wide X 5' high large windows and/or backyard sliding glass doors on the 2nd story
because the builder was well aware that to do so would restrict and minimize the privacy
of the residents living in Single StOry Familv homes directly behind a two story home.
Also, it would make it harder to sell the single story home (with less value too),

fPlIECIE~VIEIDJ

JUL (\ 7 2006

1

CiTY OF PU.::;SANTON
PLANNI[\jG DePT.

VAoI2-- \S4-2(PtW-qr
