The proposed location of the: conditional use and the conditions under <br />which it would be operated or maintained will not be detrimental to the <br />public health, safety, or well$re, or materially injurious to the properties or <br />irnprovements in the vi cinity_ <br />The parking court provides direct access to each tenant suite. Thus, operation of <br />each business should not interfere with one another. In addition, the private piano <br />lessons would be held inside the tenant space in enclosed rooms. "I'he sound <br />proofing of the walls will tr~itigate the x~oises from proposed use; thus, there will <br />be no noise impacts. <br />Given the large number of parking spaces for the building and the small demand <br />for parking that the proposed use would generate during normal business hours, <br />the trade school has adequate oft=street parking to meet the demand axed dots xzot <br />adversely impact the adjacent tenants- <br />The streets leading to the site are designed per C=ity standards and are signalized to <br />provide safe access into and out of the site. Any areas of possible content have <br />been conditioned so that the proposed use would meet all applicable Municipal <br />CJode requirements and would be operated in anon-nuisance manner- <br />Purthermore, the applicant can be required to mitigate any future nuisances or <br />problems. Therefore, this $nding can be made. <br />~. "1 he proposed conditional use will comply with each of the applicable <br />provisions of the L,oning Ordinance. <br />"1'he site's zoning regulations conditionally permit the establishxrxent of a trade <br />school for piano lessons- The use crn~nplies with all relevaL~t sections of the <br />zoning ordinance. F3 ased on the proposal and analysis on land use, noise, and <br />parking granting a conditional use permit to the existing use would be consistent <br />with the City's ability to regul etc related zoning regulations- Therefore, the third <br />fi ridirxg can be rrxade. <br />WHEREAS, the Planning Coxrimission determined that the proposed conditional use would be <br />compatible with the existing uses in the area- <br />
