b- Anl~lication= If an Applicant for a Covered Project believes such circumstances <br />exist, the Applicant txiay apply 12>r an exemption at the ti nee that he or she submits the <br />Pre-Perir~itting Documentation required under Section 17-50.050- "fhe Applicant shall indicate in <br />the Pre-Permitting Documentation Uie maximum number of credils he or she believes is practical <br />or feasible for the Covered Project and the circumstances that he or she believes n~alce it a <br />hardship or in(-casiblc to comply fully with this Chapter- Such circumstances nay include, but <br />are not limited to, avai lability of ni arkcts for materials to be recycled, availability of Green <br />Building materials and tecl-inologies, and compatibility of Green Building requirements with <br />existing building stat~dards- <br />c. "I'hc <br />Green Building Compliance Official shall return a copy of the Pre-Permitting Docwrtentation to <br />the Applicant n-iarlced "Approved with Exemption." The Green Building C'on~pliance Official <br />shall provide a copy of the approved Pre-Permitting Docum cniation niarlced "Approved with <br />Fxetnption" at the hearing on the= Design Review or Planned Unit Developtrient Design Review <br />and shall note Py the Building and Safety Division that the Pre-Penritting Documentation has <br />been approved. If an excn~ptiot~ is granted, the Applicant shall be required to comply with this <br />Chapter in al} other respects and shall be req wired to achieve, in accord ancc with this Chapter, <br />the. nun-iber of credits detc;rn~ined to be achievable by ihe% Green Building C'oniplianc~e C~fFcial- <br />Ilan exemption is granted, the Planning Commission and the City Council shall be notified of <br />the action.
