Resolution No. PC-2006-08 <br />Yage Two <br />3. The subdivision, together with its design and improvement, is consistc~~t <br />with the General Plan. <br />The PUll was found to be consistent with the ~lcneral Plan, and. this subdivision <br />is consistent with the developnZCnt pl aii. As proposed, the subdivision is <br />coiripati ble with the objectives, policies, land uses, acid programs specified itt the <br />C3cneral Plait. Therefore, this finding can be made. <br />4. The subdivision site is physically suitable fbr the type and density of <br />dcvelopn~wzt. <br />"f'Yhe site is relatively it at and has an existing residence on it. The design of the subdivision aa~d iinproven~ents arc not lilccly to cause <br />substantial environmental damage or substantially and avoidably it~jure <br />fish or wildlife in their habitat. <br />The design of the subdivision and improvements will not cause substantial <br />environmental damage nor substantially and avoidably in"jure fish or wildlife, in <br />their habitat, as evidence by the adopti oi~ by the City Council oii January l 7, 2006 <br />of the Negative Declaration and finding a cz'c: minimu.r impact to li.sh and wildlife. <br />Therefore, this finding can be made. <br />6. The design of the subdivision or type o1-in~proven~ents is not lilccly to <br />cause serious public health problems. <br />The subdivision is designed to be served by all City utilities and services at <br />established service levels. Full water and sewer service is includcd_ No <br />earthqualce, flooding, or other natural hazards exist at this site at a level dean-icd <br />"unacceptable" in the General Plan. Therefore, this finding can be made. <br />7. "11ie design of the subdivision or the type of improvements does not <br />conflict with easen~cnts for access through or use of the property. <br />The applicant will be required to abandon an existing access eascn-ient for the <br />benefit of the Jones faintly parcel. Anew access casement shall be established <br />between Lots 8 and 9 located at Street A to the Jonas parcel. The abandonment is <br />required prior to final map recordation. Therefore, this finding ca» be made. <br />8. The restriction on approving a tentative subdivision map on land covered <br />by a contract entered into pursua»t to the California Land Conservation <br />l~ct of 1965 is not applicabic. <br />The site is not covered by such a contract There fore_ this finding can be rn ade. <br />
