<br />Resolution No. 91-78 <br /> <br />4. Public notice has been provided as required by <br />Government Code Section 51284. (All references <br />hereafter to code sections are to the Government <br />Code.) <br /> <br />5. Pursuant to section 51283(a), the amount of the <br />cancellation fee shall be 12 1/2 percent of the <br />fair market value of the property on the date City <br />council approves tentative cancellation. Based <br />upon information provided by the Alameda County <br />Assessor, the City Council hereby determines that <br />the cancellation fee shall be $312,500. <br /> <br />6. Landowner's petition for cancellation was <br />accompanied by a proposal for a specified <br />alternative use of the land which listed those <br />governmental agencies known by the landowner to <br />. have permit authority related to the proposed <br />alternative use. <br /> <br />7. A public hearing has been held on the petition as <br />required by Section 51284. <br /> <br />8. The cancellation is consistent with Title 5, Part <br />I, Chapter 7 of the California Government Code. <br /> <br />9. The cancellation is for land on which a Notice of <br />Nonrenewal has been served pursuant to Section <br />51245. <br /> <br />10. Cancellation is not likely to result in the <br />removal of adjacent lands from agricultural use. <br /> <br />Existing single-family residential neighborhoods <br />surround the Bonde property on th~ee sides. To <br />the west and southwest are the Diamond Collection <br />and Vent ana Hills developments; to the east is the <br />Kottinger Ranch subdivision; and to the north is <br />the Pleasanton Heights development. The vacant <br />Lund Ranch property is located on the undeveloped <br />fourth side of the Bonde property. Uses on Lund <br />Ranch are currently limited to grazing and open <br />space uses. <br /> <br />Development on the Bonde property is designed to <br />be compatible with neighboring grazing uses on the <br />Lund Ranch property by locating only one unit . <br />along the Lund Ranch property line. Grazing <br />activities on the Lund Ranch property can continue <br /> <br />2 <br />
