<br />36. All landscaping indicated on the plans shall be installed by the applicantlhomeowner <br />upon occupancy. The landscaping plan for the rear yards shall be submitted for review <br />and approval by the Planning Director. Rear yard landscaping shall be installed within <br />nine (9) months of the occupancy. The applicant shall arrange a landscaping site <br />inspection with thc Planning Department staff upon completion of the landscaping <br />installation. <br /> <br />Biological Assessment: <br /> <br />37. The applicant shall strictly following the recommendations stated in the Biological <br />Assessment report prepared by WRA, included in Exhibit A, on file with the Planning <br />Department. <br /> <br />38. All construction shall be scheduled outside the bird-breeding season (February through <br />August). In an event that the construction cannot be scheduled outside the bird-breeding <br />season, a wildlife biologist shall be contracted at the owner's expense to conduct a <br />brecding bird survey within thirty (30) days of the scheduled construction to determine if <br />nesting birds are present. The wildlife biologist shall provide a letter stating that no <br />nesting birds are present prior to commencement of construction. <br /> <br />If nesting birds are observed, the wildlife biologist shall recommend mitigation measures <br />to minimize the construction disturbance to the nest birds. Mitigations may include but <br />are not limited to establishing buffers no less than fifty (50) feet from active nests until <br />young birds have flcdged thc nest. The written mitigations shall be submitted to the <br />Planning Dircctor for revicw and approval prior to commencement of construction. <br /> <br />39. The applicant shall collect and store seeds until it is time to reseed. Seed collection shall <br />bc in accordance with the WRA report for species. <br /> <br />Noise <br /> <br />40. The applicant shall strictly follow the recommendation stated in the Noise Study prepared <br />by Thorburn Associates, included in Exhibit A, on file with the Planning Department. <br /> <br />41. The maximum instantaneous noise level at the subject site shall not exceed of 50 dBA in <br />the bedrooms and a maximum instantaneous noise level of 5 5 dBA. in other rooms. Prior <br />to the final inspection by the Planning Department, the applicant shall provide <br />certification letter from an acoustic consultant stating the proposed devclopmcnt has mct <br />thc noise levels as stated in the General Plan. <br /> <br />Building Permit Review: <br /> <br />Page - 7 - <br />
