<br />22. The applicant shall prepare a Conditions, Convents and Restrictions (CC&Rs) to address <br />the maintenance of the private drive and the retention of the open space on each property. <br />A copy of the CC&Rs shall be submitted to the City for review and approval. This <br />CC&Rs shall be recorded with the parcel map and that a copy of the recorded document <br />shall be givcn to all property owners. <br /> <br />23. Concurrent with the recordation of a parcel map to create three single-family residential <br />parcels, the applicant shall record with the Alameda County Recorder's Office thc <br />following: <br /> <br />a) annexation of areas designated for open spaccs on Lot 2 and Lot 3 of this <br />development to the Urban Wildland Interface district of Tract 6400 (the <br />Preserves). The annexation document shall be approved by the City Attorney <br />prior to recording. <br /> <br />b) a wildland fire protection plan for the areas designated for open spaces on Lot 2 <br />and Lot 3 of this development. This document shall be reviewed and approved by <br />the Fire Marshal and the Planning Director prior to recording. <br /> <br />c) designation of the area identified as Parcel A of Lot 3 for opcn space. The specific <br />language of open space designation shall be review and approved by the City <br />Attorney prior to recording. <br /> <br />24. All retaining walls visible from Dublin Canyon Road shall be finished with natural <br />materials such as stone or wood. <br /> <br />25. The applicant shall disclose to the future owner of Lot 3 that prior to the issuance of a <br />building permit, the property owner shall submit the following: <br /> <br />a) a conformation letter from Nicholas Engineering, Inc. stating that the <br />recommendations included in the original geotechnical report prepared in 1999 are <br />applicable for the proposed development; and, <br /> <br />b) a grading and drainage plan that thoroughly evaluates the high water content on <br />the subject site. <br /> <br />26. The final grading plan for Lot 3 shall include a retaining wall between Lot 2 and Lot 3. <br />The detail ofthc retaining wall is subject to the approval by the Planning Director prior to <br />the issuancc of a building pcrmit. Additionally, the final grading shall reflect the <br />recommcndations stated in gcotechnical peer review report by Alan Kropp & Associates <br />included in the Exhibit A. <br /> <br />Page - 5 - <br />
