construction. Tree Sculpture Corporation utilizes an environmentally sound approach to
controlling insect and disease problems, implementing an integrated pest management (IPM)
approach to solving landscape problems. The firm has never failed a contract, and strives to
foster a long-term relationship with its clients. Previous clients have included the Golden Rain
Foundation at Rossmoor in Walnut Creek for the past 13 years, and the Community of Harbor
Bay Isle in Alameda for 17 years.

PROJECT DESCRIPTION

The subject project consists of litter removal, turf mowing and edging, shrub and ground cover
trimming, and weed/insect control in several street median areas; Fire Stations 1,2,3 and 5; the
Park and Ride Lot on Johnson Drive; Iron Horse Trail segment from Santa Rita Road to Busch
Road; and the care and replanting of the Main Street Color Bowls. Several of the more notable
street median areas include Sunol Boulevard, Bernal Avenue, Valley Avenue, Vineyard Avenue,
West Las Positas Boulevard, and Stanley Boulevard. Project administration is under the
direction of the Parks and Community Services Department, through the Parks Maintenance
Division.

The proposed contract contains a renewal option, which allows the term to be extended for up to
four (4) additional years. It requires the mutual agreement of both parties, and limits
negotiations to additional work and/or new plant material maintenance. It also allows for an
annual increase in the base amount of the contract, beginning in October 1 of each year,
equivalent to the Construction Cost Index for San Francisco as published in the Engineering
News Record.

Due to the difficulty in determining the timing of new median and/or trail segments requiring
similar maintenance services, staffis recommending a 3 % contract contingency in year one (I)
of the Agreement, and 7% each of the following four (4) years. Over the life of the five (5) year
contract, the final year not-to-exceed amount would be $480,000. This amount should be
sufficient to cover the costs of any additional maintenance work and annual increases per the
Construction Cost Index. Potential new median areas could include the Valley Avenue
underpass, Bernal Community Park, Phase 1 roadway, and new Vineyard Avenue; in addition to
maintenance of expanded trail routes on the Bernal Property and Vineyard Avenue.

SCHEDULE

The proposed schedule for the project is as follows:

City Council Award of Contract
Start of Contract Maintenance
End of Maintenance Period

August 15,2006
October 1, 2006
September 30, 2007

SR06:195
Page 3
