Consequently, it is necessary that the contract with S & C be amended to make available additional inspection hours to provide the same level of examination through the completion of the work. Staff is recommending that the contract with S & C be amended to provide for the extra inspection hours to assure conformance with the approved plans and specifications. Consultant amendment S & C Engineering has proposed a scope of work, to finish the inspection services, which includes a fee estimate. The basis for compensation will be on a time and materials basis. This amendment adds an additional $18,500.00 to the contract, bringing the new not-to-exceed amount to $95,670.00. Reimbursement for Consultant Fees The conditions of approval and the Pre-annexation Development Agreement for the Bernal Project require BIC to construct the Valley Avenue Railroad Undercrossing. Under terms of a reimbursement agreement for inspection services, BIC will reimburse the City for the cost of specialty inspection as part of BIC's obligation to construct the Valley Avenue Railroad Undercrossing. FISCAL IMPACT Once completed and accepted by the City, it is estimated that there will be an increase of $10,500.00 per year in operating costs, due to increased maintenance of the subject roadway improvements including landscaping and storm drainage pump station. RECOMMENDATIONS 1. Approve the attached professional services contract amendment with S & C Engineering to provide for an additional $18,500.00 in services. 2. Approve the attached Amended Reimbursement Agreement with Bernal Investment Company (BIC) to reimburse the City for the cost of the amended S & C Engineering contract. SR:06: 198 Page 3 of 4
