CITY COUNCIL OF THE CITY OF PT2~SANTON <br /> <br /> ALAMEDA COUNTY, C~T~FORNIA <br /> <br /> RESOLUTION NO. 91-37 <br /> <br /> RESOLUTION APPROVING A MITIGATED NEGATIVE <br /> DECLARATION FOR THE APPT.TCATION OF MOT~.~R <br /> PROPERTIES AS FIreD UNDER CASE PUD--90-19 <br /> <br />WHEREAS, at its meeting of March 19, 1991, the City Council <br /> received a proposed mitigated negative declaration for <br /> the application of Moller Properties, for development <br /> p~an approval to allow the construction of 99 residential <br /> dwelling units on a 198 acre site located generally to <br /> the west/northwest of the Foothill Road/Muirwood Drive <br /> intersection; and <br /> <br />WHEREAS, the City Council has received and reviewed the Initial <br /> Study dated January 10, 1991 and received the <br /> recommendations of the staff and Planning Commission; and <br /> <br />WHEREAS, a duly noticed public hearing was held at which time the <br /> public was given the opportunity to comment on the <br /> environmental impacts of the proposed development plan; <br /> and <br /> <br />WHEREAS, the City Council has reviewed the potential impacts in <br /> accordance with the applicable state and localguidelines <br /> governing the preparation of Mitigated Negative <br /> Declarations and Environmental Impact Reports; and <br /> <br />WHEREAS, the City Council finds that based upon the review of the <br /> Initial Study and the testimony and documentary evidence <br /> presented at the public hearing that there may be <br /> significant impacts on the environment, but that the <br /> developer has agreed to mitigation measures to render <br /> these potential impacts insignificant; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br /> <br />
