Contract Reference No. CONTRACT THIS CONTRACT, made and entered into this,2~day of/~'~, 19~_~ by and between the CITY OF PLWASANTON, a body corporate and politic of the State of California, hereinafter referred to as "City" and Kaleidoscope Activity Center hereinafter referred to as "Contractor". - ' WHEREAS, City is desirous of contracting with Contractor for the provision of certain services, a description of which are presented in Exhibit A, attached hereto; and WHEREAS, City is receiving funds pursuant to the Community Development Block Grant Program, funded by the U. S. Department of Housing and Urban Develo~nent; and WHEREAS, Contractor is willing and able to perform duties and render services which are determined by the City Council to be necessary or appropriate for the welfare of residents of City; and W~IEREAS, City desires that such duties and services be provided by Contractor, land Contractor agrees to perform such duties and render such services, as more particularly set forth below: NOW, THEREFORE, IT IS HEREBY ML~U3~Y AGP~ as follows: 1. Attached hereto, marked Exhibit A, and by this reference made a part hereof, is a description of the duhies a~d services to be performed for City by Contractor, and Contractor agrees to comply with all provisions, to perform all work, and to provide all such duties and services set forth in Exhibit A in a professional and diligent manner. - 2. City has allocatd the sum of $ 25,000 to be expended as described in this contract. Unless an amendment to this contract otherwise provides, that amount shall in no event be exceeded by Contractor, and City shall under no circumstances be required to pay in excess of that amount. Payment shall be made pursuant to the terms and conditions set forth in Exhibit B, attached hereto and by this reference made a part hereof. Sums not so pai--d shall be retained by City. 3.
