D. This Agreement provides for the allocation of costs to the seven <br />cities (Alameda, Albany, Berkeley, Dublin, Livermore, Piedmont, Pleasanton) <br />not in a DISTRICT Zone where benefit assessment fees are paid, and for the <br />reimbursment of these seven cities' costs to DISTRICT. <br /> <br /> E. There are seven cities within Alameda County where DISTRICT <br />benefit assessment fees are collected. Their costs will be paid from the <br />appropriate DISTRICT Zone benefit assessment reserves. <br /> <br />AGREEMENT: <br /> <br /> 1. A task force consisting of representatives of agencies specified <br />in "Exhibit A" (Alameda County Nonpoint Source Control Task Force Member <br />Agencies), attached hereto and made a part hereof, shall oversee and guide <br />the development, by the consultants so engaged, of the Program mentioned in <br />Recital B above. <br /> <br /> 2. The parties shall share the costs of the Program in the <br />proportions stated in "Exhibit B" (Schedule of Cost Sharing for the <br />Development of the Alameda County Nonpoint Source Control Management <br />Program), attached hereto and made a part hereof. The indicated amounts are <br />based on populations and runoff contributing areas of the respective <br />jurisdictions, and are the same proportions as those developed for the <br />monitoring program currently in progress. <br /> <br /> 3. DISTRICT is providing a coordinating role in the development of <br />this Program, and has secured the services of consultants to perform the <br />services specified in "Exhibit C" ("Alameda Nonpoint Source Control program <br />NPDES Permit Application"), attached hereto and made a part hereof, in <br />accordance with DISTRICT procedures on selection of professional <br />consultants. The DISTRICT's contracts with the consultants contain hold <br />harmless and indemnity provisions for the benefit of all parties to this <br />agreement. <br /> <br /> 4. The total Program costs to be apportioned shall not exceed <br />$300,750.00 <br /> <br /> 5. This agreement shall be effective upon execution by the Parties. <br /> <br /> 6. The DISTRICT will invoice each city in March of 1991 for their <br />share of the Program's costs. Any adjustments to total costs will be made <br />and invoiced upon completion of work contracted for by the DISTRICT on <br />behalf of the Task Force. <br /> <br /> -2- <br /> <br /> <br />
