<br />ATTACHMENT 3 <br /> <br /> <br />CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />ORDINANCE NO. <br /> <br />AN ORDINANCE APPROVING THE APPLICATION OF KAZUO AND TAKIKO <br />HA TSUSHI FOR PUD DEVELOPMENT PLAN APPROVAL <br />AS FILED UNDER CASE PUD-99-14 <br /> <br />WHEREAS, Kazuo and Takiko Hatsushi have applied for Planned Unit Development (PUD) <br />development plan approval of a new development consisting of 13 new <br />single-family custom lots and one existing single-family home on an <br />approximately IS-acre site lot located at 27S6, 2770, and 2798 Vineyard Avenue <br />within the Vineyard Corridor Specific Plan Area; and <br /> <br />WHEREAS, zoning for the property is PUD-LDR and OS (Planned Unit Development - Low <br />Density Residential and Open Space) District; and <br /> <br />WHEREAS, the environmental review for the proposed project was undertaken with the Final <br />Environmental Impact Report (EIR) for the Vineyard Avenue Corridor Specific <br />Plan, certified by the City Council on March 1999, in conformance with the <br />standards of the California Environmental Quality Act (CEQA); and there are no <br />substantial changes to the project or the circumstances under which the project is <br />being undertaken that involve new significant environmental effect or that <br />substantially increase the severity of previously identified effects; furthermore, <br />there is no new information of substantial importance which was unknown at the <br />time that the EIR was approved by the City Council regarding the project or its <br />effects, mitigation measures, or alternatives, and any previously identified effects <br />or impacts are mitigated to a level of insignificance, with the mitigation measures <br />incorporated into the project's design or imposed on the project pursuant to the <br />conditions of approval; and <br /> <br />WHEREAS, the Council received the Planning Commission's recommendations for approval <br />of development plan; and <br /> <br />WHEREAS, a duly noticed public hearing was held on June 20, 2006; and <br /> <br />WHEREAS, the City Council finds that the development plan and site development standards <br />are consistent with the General Plan, the Vineyard Avenue Corridor Specific <br />Plan, and the purposes ofthe PUD ordinance. <br />
