Hatsushi's land for the Beratlis <br />development. <br /> <br />I must apologize in advance for not being able to attend the planning meeting on July 13, <br />but a family medical issue has me flying to Montana on that same day. Otherwise, I would definitely attend, and remain happy <br />to field any/all questions from the city or other interested parties. <br /> <br />I'd like to make sure the Planning Commission understands that any development activity on the acreage in question, whether <br />by Mr. Beratlis or the Hatsushi family, is of unique impact to my home and family because our is the closest home to that <br />location - our house is literally 21 feet from the fence line for that acreage, and approximately 50 feet from the proposed <br />stockpile. <br /> <br />Here are items that I consider of extreme importance for me to support this plan. My general justification for these items is the <br />potential for damage to my property caused by the earthmoving/sculpting activity, the level of dust/dirt that will accumulate <br />during the activity, and the impact on our viewscape for an indeterminate period after the activity: <br /> <br />1. The stockpile is maintained at least 1 foot below the existing elevation of my property line, within a line of sight from <br />anywhere on my property to the eastern extent of the stockpile. This generally concurs with the proposed plan drawing, dated <br />7/1/05. <br /> <br />2. The stockpile is sculpted to look as natural as possible, and hydroseeded/irrigated within 2 weeks of being finished, to <br />regrow grasses and reobtain a natural appearance. <br /> <br />3. Construction hours/days strictly maintained from 8 am - 5pm, Mon - Friday. <br /> <br />4. A dust control plan put into place during the activity, including daily watering to keep dust to a minimum. <br /> <br />5. A drainage plan put into place to ensure that erosion does not occur from the stockpile or any of the contours around the <br />stockpile, and that no water or mud would enter my property, caused by the stockpile. <br /> <br />6. Mr Hatsushi and Mr Beratlis accept full liability for any damages caused to my property from any of the activities involved in <br />the creation and ongoing existence of the stockpile. Of particular concern to me are cracks/shifting of our pool, cracks/shifting <br />of our house foundation, and cracks/shifting of our rear fence. This would be determined by professional inspection of my <br />property at the completion of the activity, and an inspection within 12 months of completion, at Mr. Beratlis' expense. It is <br />optional to have the property inspected before the activity begins. <br /> <br />7. The stockpile is 90% compacted, to minimize the chance for erosion and sliding. <br /> <br />Here is a list of requests I have that would greatly reduce the annoyance factor to my family during this activity. You have <br />already warned me that some of these items may not be feasible, but I'd like to make the request anyway: <br /> <br />1. Delay beginning this activity to September 1, so we aren't affected during the summer months while the kids are out of <br />school, and we are enjoying maximum use of our backyard. <br /> <br />2. Finish the work as quickly as possible after it has begun - within three weeks of initiation, to minimize the period of noise/dirt. <br /> <br />Please call me if you have any questions. <br /> <br />/21/2006 <br />
