<br />Water Tank Site (off Tassajara Road in Dublin) for such purposes. The company's <br />representatives have stated that antennae in those locations will better serve its customers in <br />Pleasanton and the Tri-Valley area. <br /> <br />City staff from the Public Works Utilities Division met with the company's representatives at <br />the sites to understand what was being proposed and City staff has determined the proposed <br />location at the sites will not interfere in any respect with the City's operation of the tank sites. <br />Other City staff then met with the company to negotiate the terms of a proposed lease. Those <br />terms are discussed below. <br /> <br />DISCUSSION <br /> <br />The rent at each site will be $2000 per month, with a 3% increase annually. There is an initial <br />term of five years with four five year options; the total term of the lease could be 25 years. The <br />company will be leasing only a small area of each site: about 600 square feet of the Moller <br />Ranch tank site and 250 square feet of the Tassajara tank site. The company shall have the right <br />to construct on the property improvements necessary to operate its communication system, shall <br />have the right to remove the improvements at the end of the lease, and shall have access to the <br />site in order to maintain its facilities. The company shall not, however, use the property in any <br />way that interferes with the City's use of the property and the City may terminate the lease if the <br />company's use of the property unreasonably interferes with the City's use, although that is not <br />expected to occur. <br /> <br />Zoning Approvals <br /> <br />Locating cellular antennae within the City of Pleasanton is subject to the City's zoning <br />ordinance in terms of distance from certain uses, such as residential areas. The City of Dublin <br />has a similar ordinance. The location of these antennae appear to be within the regulations of <br />Pleasanton and Dublin. Nevertheless, the company has been advised that Pleasanton retains its <br />full discretionary land use authority over the planning application for the antenna within <br />Pleasanton and the Council's approval of this lease is a process separate from the land use <br />decision. <br /> <br />FISCAL IMPACT <br /> <br />Over a 25 year stretch, each lease will generate $875,020. <br /> <br />STAFF RECOMMENDATION <br /> <br />Staff concludes that the location of these antennae on these two sites will have no impact on the <br />delivery of water to City customers and will provide a significant revenue stream over the next <br />25 years. Accordingly, staff recommends that the Council authorize the City Manager to sign <br />the necessarv documents to lease a portion of these two sites to Omnipoint Communications. <br /> <br />SR:6: 173 <br />Page 2 <br />
