LAND USE ISection 4.1! <br /> <br />SIGNIFICANT EFFECT <br /> <br />Impact 4.1-4: Land Use Compatibility. - Residential with Agricultural Land Uses. The proposed <br /> Specific Plan designates areas in the northern portion of the Plan Area for vineyards and other <br /> potential agricultural operations. An existing vineyard use on Lot 26 would also continue after <br /> implementation of the proposed Plan. Land use compatibility conflicts could occur between the <br /> proposed residential uses and existing and proposed agricultural operations. Residents could <br /> potentially be exposed to dust, pesticides, fertilizers, odors and noise associated with agricultural <br /> operations and in turn could oppose and seek the termination or a reduction in the agricultural <br /> uses within the Plan Area. This is considered a potentially significant land use compatibility <br /> impact. <br /> <br />Changes or alterations have been required in, or incorporated into, the project which mitigate or avoid <br />the significant effects on the environment. <br /> <br />Facts in Support of Finding <br /> <br />The City of Pleasanton has adopted the following measures which will reduce potential land use impacts <br />to a less-than-significant level: <br /> <br />Mitigation Measure 4.1-4: Land Use Compatibility. - Residential with Agricultural 1jand Uses. The <br /> Specific Plan requires that urban uses be separated from existing and proposed agricultural <br /> operations through buffers such as streets or passive open space. <br /> <br />Purchasers and renters of property are required to sign a statement to be included in their deed of sale or <br />rental/lease agreement to protect agricultural uses fi'om nuisance lawsuits. The statement shall read as <br />follows: <br /> <br /> "You are hereby advised that this property is located near land zoned and/or used for <br /> agricultural purposes. Agricultural use is defined as including but not limited to day and <br /> night time activity relating to livestock grazing, the keeping of livestock, the growing <br /> and processing of agricultural crops, and any commercial agricultural practices <br /> performed as incidental to or in conjunction with such operations. Some of the impacts <br /> associated with agricultural use include but are not limited to noise, odors, dust, <br /> chemicals, refuse, waste, unsightliness, use of agricultural equipment, and traffic. <br /> Permitted agricultural pursuits conducted in accordance with good practice and <br /> maintenance are not deemed by the City of Pleasanton to be a nuisance." <br /> <br />Site-specific vineyard and open space management plans shall be prepared and submitted by each <br />developer of lots which contain vineyard land as a part of the PUD development plan application. Plans <br />shall address agricultural operations and wildlife and vegetation preservation needs. <br /> <br />Additional measures are included in Chapter 4 of this report to mitigate land use compatibility impacts <br />between agricultural operations and residential uses, including noise, dust generation, and <br />fertilizer/pesticide use. <br /> <br />Vineyard Avenue Corridor Specific Plan Draft EIR -6- Findings <br /> <br /> <br />
