FINDINGS OF FACT FOR THE VINEYARD AVENUE CORRIDOR SPECIFIC PLAN <br /> <br /> SECTION 1 <br /> STATEMENT OF FINDINGS <br /> <br />INTRODUCTION <br /> <br />The Vineyard Avenue Corridor Specific Plan (Specific Plan) is intended to serve as the primary land use <br />and regulatory guide for development of the 384-acre Plan Area. The objective of the Specific Plan is to <br />establish a high-quality living environment that features a rural/vineyard character and provides for a <br />variety of residential, commercial, vineyard, open space, recreational, elementary school and other uses. <br />The Specific Plan sets forth the basic land use pattern, development and design standards, circulation <br />network, infrastructure system, and implementation requirements for future development. <br /> <br />The City of Pleasanton has prepared an Environmental Impact Report (EIR) for the Specific Plan in <br />compliance with the California Environmental Quality Act of 1970 (CEQA) (Public Resources Code <br />§21000 et seq. ) and the State CEQA Guidelines (California Administrative Code § 15000 et seq., as <br />amended). <br /> <br />CEQA and the State CEQA Guidelines provide that: <br /> <br />No public agency shah approve or carry out a project for which an Environmental Impact Report has <br />been certifed and which identifes one or more signifcant environmental effects that would occur if the <br />project is approved or carried out unless both the following occur.' <br /> <br /> (a) The public agency makes one or more of the following findings with respect to each <br /> significant effect: <br /> <br /> (1) Changes or alterations have been required in, or incorporated into, the project <br /> which mitigate or avoid the significant effects on the environment. <br /> <br /> (2) Those changes or alterations are within the responsibility and jurisdiction of <br /> another public agency and have been, or can and should be, adopted by that <br /> other agency. <br /> <br /> (3) Speci~c economic, legal social technological or other considerations, <br /> including considerations for the provision of employment opportunities for <br /> highly trained workers, make in feasible the mitigation measures or alternatives <br /> identifified in the environmental impact report. <br /> <br /> (b) With respect to significant effects which were subject to a finding under paragraph (3) of <br /> subdivision (a), the public agency finds that specific overriding economic legal social <br /> technological or other benefits of the project outweigh the significant effects on.the <br /> environment. [Public Resources Code §21081 ] <br /> <br />Because the EIR identified significant effects which may occur as a result of the project, and in <br />accordance with the provisions of the guidelines, the City of Pleasanton hereby adopts these findings as <br />part of the approval of the Vineyard Avenue Corridor Specific Plan. <br /> <br />Vineyard Avenue Corridor Specific Plan Draft EIR -1- Findings <br /> <br /> <br />
