Shall the EVA location be different then what is shown in the Vesting <br />Tentative Map of Tract 7399-Silver Oak Estates, that map shall be adjusted. <br /> <br />Issue 2 - Sports Courts <br />PUD-54 condition 18(r) should state that sport courts are not allowed due to visual and noise <br />impacts. lighted facilities are not appropriate in hillside residential in this location. Because of <br />the location of this development, any sports court would create echoing to all adjacent properties <br />because of the topology and would be a noise impact. There would be no way to buffer the noise <br />to the outside receptors. <br /> <br />Recommendation: No sports courts, lighted or otherwise, shall be located in the <br />hillside residential lots. <br /> <br />Issue 3 . Disclosures <br />Since this property is adjacent to my property, lot 24, the same disclosures about pigs should be <br />present for this project as was required for lot 18 because of the proximity to an existing pig <br />operation. A disclosure should be added to state that: <br /> <br />Recommendation: "Animal husbandry activities, including pig farming, of nearby <br />property owners in the Specific Plan area shall be prominently displayed in the <br />sales office for this development and within the CCR's" <br /> <br />Issue 4 . Hours of Construction <br />PUD-54 condition 33 has the hours of construction Monday through Saturday. To be consistent <br />with all other previously issued PUD's in this Plan area, the construction hours shall by Monday <br />through Friday. The only exceptions made to the Monday through Friday restrictions to date have <br />been for Lots 18 and 19 for the construction of New Vineyard Avenue although the rest of the <br />construction on those properties is still Monday through Friday. <br /> <br />PDR-520 has the same issue of construction time as condition 19. This condition should also be <br />changed to Monday through Friday. The location of this development as well as the Reznick <br />homes are in the hills and the noise travels far since there is no way to buffer the noise. The <br />noise here would effect existing residents in the Vineyard Corridor as well as those under <br />construction which could be occupied before the water tank is completed. <br /> <br />Recommendation: Construction for PUD-54 and PUD-520 can only take place <br />Monday through Friday, excluding holidays <br /> <br />Issue 5 - Buildina Heiahts <br />The Staff Report asks for exceptions of building height for lots over 540 feet. The Specific Plan <br />on page 25 states that "Primary buildings located on Lot 17 and on existing elevations <br />exceeding 540 feet shall be limited to 25 feet in height and one story". It would be in conflict <br />of the Specific Plan, and require a Specific Plan change, to allow homes over 25 feet in height at <br />this elevation. The Specific Plan states, "Minor variations may be permitted." Allowing 5 out <br />of the 7 homes to be over 25 feet is not a minor variation. If it can be found that the house <br />heights can be over 25 feet while being completely screened from off-site (including existing <br />residents in the Vineyard Corridor), this finding could possibly be made but there is not enough <br />information at this time to make this finding. <br /> <br />Recommended language: "Although the Specific Plan limits building heights on <br />existing elevations exceeding 540 feet for 25 feet in height and one story, building <br />heights may be allowed to exceed 25 feet or two-story on a case-by-case basis if <br />
