<br />Resolution No. 06-036 <br />Page Two <br /> <br />WHEREAS, the City prepared a Draft EIR for the Project which was published on February 1, <br />2006 and provided proper legal notice of document preparation and availability; <br />and <br /> <br />WHEREAS, the Planning Commission held a noticed public hearing on February 22, 2006 to <br />accept oral comments on the Draft EIR during the forty-five-day public review <br />period, and the City also accepted and responded to written comments to the Draft <br />EIR received from public agencies having jurisdiction by law, persons having <br />special expertise with respect to any environmental impacts involved, and other <br />persons and organizations having an interest in the Project; and <br /> <br />WHEREAS, the Final EIR for the Project was prepared and contains the Draft EIR, comments <br />and recommendations received on the Draft EIR and the responses to comments <br />raised regarding environmental issues in the review and consultation process; and <br /> <br />WHEREAS, the City provided proper notice of completion of the Final EIR; and <br /> <br />WHEREAS, on April 26, 2006, the Planning Commission found the Final EIR to be complete <br />and adequate for the Project and recommended to the City Council that the <br />Final EIR be certified; and <br /> <br />WHEREAS, on May 16,2006, the City Council certified the Final EIR for the Project. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: Adopts the CEQA Findings and Statement of Overriding Considerations prepared <br />for the Project, attached as Exhibit C. <br /> <br />Section 2: Finds that the proposed Bernal Property Phase II Specific Plan, as amended, is <br />consistent with the General Plan and the Bernal Property Phase I Specific Plan. <br /> <br />Section 3: Adopts the Bernal Property Phase II Specific Plan, dated January 2006, attached as <br />Exhibit A, as amended per the attached Exhibit B. <br />
