Resolution No. 99-043 <br />Page Two <br /> <br />WHEREAS, the City Council determines that the Planning Commission's actions regarding the <br /> proposed modifications to the site and building are appropriate. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: Denies Case AP-99-02, thereby upholding the Planning Commission's actions <br /> regarding the application of Diane and Edward Churka (Case Z-99-25), to deny the <br /> applicants' request to delete the trellis from the lower patio area; to approve the <br /> applicants' request to eliminate the wood sill and four-inch wide wood trim band <br /> around all of the windows; to approve the applicants' request to move the lower <br /> patio fence closer to the western (Main Street) property line, but not directly <br /> adjacent to it as requested; and to deny the applicants' request to eliminate the <br /> one-foot tall brick borders along the western side of the patio area, all with respect <br /> to the previously-approved Coffee Roast Express building under construction at <br /> 780 Main Street. <br /> <br />Section 2: The City Clerk shall forward a certified copy of this resolution to the appellant <br /> with a notice that he has ninety (90) days following the date of adoption of this <br /> resolution in which to seek judicial review of this action of the City Council. <br /> <br />Section 3: This resolution shall become effective immediately upon its passage and adoption. <br /> <br /> <br />
