CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 99-043 <br /> <br /> RESOLUTION DENYING THE APPEAL (CASE AP-99-02) <br /> AND THEREBY UPHOLDING THE DECISION OF THE <br /> PLANNING COMMISSION REGARDING THE <br /> APPLICATION OF DIANE AND EDWARD CHURKA, AS <br /> FILED UNDER CASE Z-99-25 <br /> <br />WHEREAS, Diane and Edward Churka applied for design review approval to modify the <br /> previously-approved Coffee Roast Express building under construction at 780 <br /> Main Street; and <br /> <br />WHEREAS, the Planning Commission denied the applicants' request to delete the trellis from <br /> the lower patio area; approved the applicants' request to eliminate the wood sill <br /> and four-inch wide wood trim band around all of the windows; approved the <br /> applicants' request to move the lower patio fence closer to the western (Main <br /> Street) property line, but not directly adjacent to it as requested; and denied the <br /> applicants' request to eliminate the one-foot tall brick borders along the western <br /> side of the patio area; and <br /> <br />WHEREAS, within the time specified by the Pleasanton Municipal Code, Jack Hovingh, a City <br /> of Pleasanton resident, filed an appeal of the Planning Commission's actions, <br /> stating that the window treatments should be installed as previously approved, with <br /> the exception that the wood sill would not be necessary on the first floor windows <br /> that already have brick sills; and <br /> <br />WHEREAS, a duly noticed public hearing on the appeal was held before the City Council on <br /> April 6, 1999; and <br /> <br />WHEREAS, actions of this nature are categorically exempt from the requirements of the <br /> Califomia Environmental Quality Act (CEQA); therefore, no environmental <br /> document was prepared for this matter; and <br /> <br /> <br />
