<br />Honorable Mayor and Members of the City Council: <br /> <br />BACKGROUND <br /> <br />The property owner, Rick Hempy of 351 Virginia Way, is requesting connections to the City <br />water and sewer systems to serve a proposed new lot located within the Remen Tract, which is <br />outside the City limits. He currently has an approved Tentative Parcel Map with the County, <br />which allows him to subdivide 351 Virginia Way into two lots. His existing residence on this <br />parcel currently has City water and sewer services. In 1997, Hempy received approval from the <br />City allowing for City water and sanitary sewer services for the existing dwelling at 351 Virginia <br />Way. There is a Preannexation Agreement with the City for this parcel. <br /> <br />The proposed parcel map at 351 Virginia Way is configured with two lots facing Virginia Way <br />for a total of 1.52 acres. Parcel One is 20,919 square feet (0.48 acres) and Parcel Two is 45,108 <br />square feet (1.04 acres). Parcel Two has the existing residence. As a requirement of the <br />Preannexation Agreement, the applicant will submit house plans for Parcel One to the City for <br />design review prior to the issuance of building permits by the County and encroachment permits <br />for utility connections by the City. <br /> <br />Proposed Improvements <br /> <br />The applicant is proposing several subdivision improvements, which were recommended by <br />staff. As part of this development, the applicant would extend the water main to the north end of <br />Virginia Way, including the installation of a fire hydrant on Virginia Way. The new water main <br />will improve the water system within the Remen Tract. There is an existing sanitary sewer main <br />on Virginia Way, which was installed previously by Hempy. The applicant would also be <br />required to pay a pro-rata share of future Virginia Way street improvements along his property <br />frontage. These conditions have been added to the Preannexation Agreement. <br /> <br />Preannexation and Provisions of Water and Sanitarv Sewer Agreement <br /> <br />Historically, when an owner of a property located outside the City limits requests water and <br />sewer services, the City has granted such requests only after determining that the use on the <br />property to be serviced is consistent with the City's General Plan, and after receiving assurances <br />that the property owner will enter into a preannexation agreement. This agreement allows the <br />owner to connect to the City's water and sewer systems prior to the property being annexed to <br />the City providing the following requirements are met: The property owner agrees to (a) pay the <br />water and sewer connection fees, (b) pay all costs associated with the connection to and use of <br />the water and sewer systems, (c) abandon the existing septic system on the property, (d) pay all <br />City and County processing fees for LAFCo approval, (e) support any subsequent annexation <br />initiative that may occur. <br /> <br />SR 06:141 <br />Page 2 of 4 <br />
